You may request only after a diagnosis of terminal illness, and with the consent of a second doctor, other than that which made the diagnosis. The doctor also must be satisfied that the patient's will is genuine, untainted and informed. So far, assisted suicide has been applied in over two hundred cases. In Ascroft 2001, the Minister of Justice has issued a decree interpretation of the Controlled Substances Act of 1970, which governs the administration of drugs, and has thus made this illegal practice. The decree has been challenged (brought before a judge who determined that legitimacy) and is canceled in the first instance and court of appeal. The Supreme Court has ruled on the case Jan. 17, 2006 in the sense already outlined by the state courts, with a majority of six out of nine.
